STATE OF NEW YORK
EXECUTIVE CHAMBER
Proclamation
Pursuant to the power vested in me by Article IV, Section 3 of the Constitution, I hereby convene the Senate of the State of New York in Extraordinary Session, at the Capitol, in the City of Albany, on the twenty third day of June, two thousand nine, at three o’clock, for the purpose of considering legislation with respect to:
(1) extending the Power for Jobs program;
(2) extending compliance with the federal Individuals with Disabilities Education Act;
(3) extending mayoral control of New York City schools, and extending the exemption from the Wicks Law for the School Construction Authority;
(4) making permanent “Timothy’s Law”, which would otherwise expire on December 31, 2009;
(5) requiring New York City bond anticipation notes to mature no later than one year of date of issuance;
(6) authorizing licensed lenders to charge annual fees on open-end loans;
(7) authorizing an additional half percent increase in New York City sales tax;
(8) increasing by $500 million the maximum bonding authority of the New York State Housing Finance Agency and extending the Agency’s authority to issue bonds to June 30, 2011;
(9) extending the State’s authority to enter into construction contracts without formal competitive bidding in certain emergencies, which would otherwise expire on June 30, 2009;
(10) extending certain provisions to comply with the No Child Left Behind Act, including provisions regarding supplemental educational services, unsafe school choice and compliance with the Gun Free Schools Act, as well as provisions regarding the education of homeless children and the transfer of student disciplinary records until June 30, 2010;
(11) authorizing the town of Deerpark in the County of Orange to issue bonds and bond anticipation notes, which would otherwise expire on June 30, 2009;
(12) extending arbitration between certain public employee organizations representing public employees, which would otherwise expire on July 1, 2009;
(13) extending the ability to complete construction of a residence where construction was previously commenced, which would otherwise expire on July 1, 2009;
(14) extending the conditional appointment of school district, charter school or Boards of Cooperative Educational Services employees, which would otherwise expire on July 1, 2009;
(15) extending for an additional year authority of local boards of elections to provide write-in vote opportunities, which would otherwise expire on July 10, 2009;
(16) extending the New York City interest rate exchange agreements, sale of bonds of the City of New York and variable rate debt, which would otherwise expire on July 15, 2009;
(17) extending New York City’s bond guidelines, which would otherwise expire July 15, 2009;
(18) extending certain powers of the New York State Infrastructure Trust Fund in the New York State Mortgage Agency (“SONYMA”), which would otherwise expire on July 16, 2009;
(19) extending the powers of SONYMA to purchase forward commitment mortgages and to issue new money tax-exempt bonds and new money taxable bonds, and increase the maximum amount of SONYMA’s authority to issue new money tax-exempt bonds, which would otherwise expire on July 16, 2009;
(20) authorizing the City of Rye, County of Westchester, to enact a room occupancy tax not to exceed 3%;
(21) extending the restriction on contacts during the procurement process, which would otherwise expire on July 31, 2009;
(22) extending the expiration date which authorized the Department of Environmental Conservation to engage in sweepstakes or contests to otherwise increase subscribers of the Conservationist magazine, which would otherwise expire on August 1, 2009;
(23) extending the amounts of benefits to be provided to a household receiving public assistance, which would otherwise expire on August 22, 2009;
(24) making permanent both military and other overseas voters to apply and obtain a paper ballot for primary, general and special elections and to expand the time frame for returning such ballots, which would otherwise expire on December 31, 2009;
(25) allowing the Division of Veterans’ Affairs to fund local veterans service agencies at the level of current appropriations;
(26) implementing CUNY Teamsters, NYSCOPA and Council 82 paybills;
(27) granting the New York State Bridge Authority the power to issue bonds and notes;
(28) allowing for bonding out of Rockland and Nassau counties incentive payments;
(29) regulating mortgage loan originators;
(30) defining when health insurance benefits are “reasonable in cost” and “reasonably accessible” as required by federal regulation;
(31) extending freeze on medical malpractice insurance rates;
(32) extending various county mortgage recording taxes;
(33) updating various provisions within the labor law relating to the Self Employment Assistance Program;
(34) extending the Village of Suffern Parking Authority, which would otherwise expire on December 31, 2009;
(35) extending contracts with managed care organizations, which would otherwise expire on December 31, 2009;
(36) extending the authorization for East Hampton to issue certain serial bonds, which would otherwise expire on December 31, 2009;
(37) extending the authority of New York banks to exercise the powers of their federal counterparts, which would otherwise expire on September 10, 2009;
(38) extending the personal income tax surcharge in the City of Yonkers, which would otherwise expire on September 30, 2009;
(39) extending the authority to issue deficit financing bonds to the City of Olean, which would otherwise expire on October 1, 2009;
(40) extending the authority of the Health Commissioner of Nassau County to enforce certain provisions of the Environmental Conservation Law for water pollution control, which would otherwise expire on October 1, 2009;
(41) extending the demonstration program to research the effect of safe patient handling programs in health care facilities across New York State, which would otherwise expire on October 18, 2009;
(42) extending the authorization of Chautauqua County to increase its occupancy tax, which would otherwise expire on November 30, 2009;
(43) extending or increasing various county additional sales and compensating use taxes, and local government assistance programs, which would otherwise expire on November 30, 2009;
(44) extending the sales tax exemption on the maintenance, repair, overhaul or rebuilding of aircraft, which would otherwise expire on November 30, 2009;
(45) extending the county of Columbia to collect an additional transfer tax, which would otherwise expire on December 31, 2009;
(46) authorizing the imposition of mandatory surcharge for traffic offenses in Suffolk and Nassau counties;
(47) conforming certain New York City tax laws with New York State tax law;
(48) authorizing unincorporated business tax reduction;
(49) extending sales and rent tax exemptions and exemptions in lower Manhattan;
(50) extending the annual rate of interest of five New York City actuarially funded retirement systems;
(51) extending authorization to New York City to enter into interest rate swap agreement;
(52) making permanent the ability of the comptroller to waive interest and penalties in unusual circumstances, which would otherwise expire on January 1, 2010;
(53) providing a mechanism for the orderly and efficient tax-exempt, private activity bond allocation process for state and local issuers by extending for an additional year the current allocation system and modifying use of bond allocations and multi-year set asides; and
(54) modifying New York City’s Energy Cost Savings Program (“ECSP”) and Lower Manhattan Energy Program (“LMEP”) to establish eligibility for the Industrial and Commercial Abatement Program as a basis for eligibility for ECSP and LMEP;
(55) extending the authorization of New York City marshals to exercise the same functions, powers and duties as sheriffs with respect to the execution of money judgment; and
for the consideration of legislation with respect to such other subjects as I may recommend.
